This agreement made this 4th March one thousand eight hundred and eighty
four between Jane Cain of the town of Douglas widow and administratrix of
Thomas Cain late of Stanley Mount in the said town of Douglas of the one
part and Thomas Cain of the said town of Douglas Millerwright executor of
the will of Elizabeth Cain late of Ballasalla in
the parish of Malew spinster decease of the other part.
And whereas the said Elizabeth Cain departed this life on or about the
Twenty ninth day of January one thousand eight hundred and eighty four
without having received the share of the proceeds of the personal estate of
the said Thomas Cain decease which estate was not fully
administered during the lifetime of the said Elizabeth Cain deceased.
And whereas the said Thomas Cain executor as aforesaid was on the twenty
eight day of February one thousand eight hundred and eighty four sworn
executor of the will of the said Elizabeth Cain deceased.
And whereas the said Thomas Cain executor as aforesaid hath called for an
account of the personal estate of the said Thomas Cain deceased and the said
Jane Cain administratrix as aforesaid hath returned an account
to record of which a copy is annexed hereto and marked A.
And whereas the said Thomas Cain executor as aforesaid hath fully examined
the said account and approves thereof.
And whereas the said account shews a balance in the hands of the said Jane
Cain administratrix as aforesaid of two hundred and sixty pounds. And
whereas the said Jane Cain administratrix as aforesaid hath paid to the said
Thomas Cain executor as aforesaid the sum of one hundred and thirty pounds
being one moiety of the said balance in her hands.
Now this agreement witnesseth that the said Thomas Cain executor as
aforesaid doth hereby own and acknowledge to have received the said
sum of one hundred and thirty pounds in full discharge and satisfaction
of all claims as executor of the said Elizabeth Cain upon the estate of
the said Thomas Cain decease and the said Thomas Cain executor as aforesaid
doth declare that he hath fully examined the said account and doth own that
the same contains a statement of all sums which have
been or ought to have been received by the said administratrix belonging
to the said Estate of the said Thomas Cain deceased and further that the
payments which she the said administratrix credits herself with having made
are properly made and the said Thomas Cain executor as aforesaid doth
hereby release discharge and for ever acquit the said Jane Cain
administratrix as aforesaid and the estate of the said Thomas Cain deceased
from all claim or demand soever in respect of the moiety of the said estate
to which the said Elizabeth Cain deceased was entitled as aforesaid. Thomas

At Douglas the 14th day of March 1884 W. F. Dickenson the subscribing
witness to the execution of the foregoing died and account annexed thereto
who is known to me personally appeared and made oath on the
Holy Evangelists that Thos Cain the executing party thereto duly signed the
same in his presence.

The humble petition of Elizabeth Cain of Ballasalla in the parish of
Malew spinster.
Sheweth: That Thomas Cain late of Mount Havelock in the town of Mount
Havelock in the town of Douglas died on or about the 29th day of October
last intestate.
That your petitioner is desirous that some fit and proper person should
be appointed to administer the estate of the said Thomas Cain.
Wherefore your petitioner prays a hearing hereof and that some fit and
proper person may be appointed to administer the estate of the said Thomas
Cain and she will pray. Thos Kneen for petitioner.
Ordered that this petition do come on to be heard at Eccl Court to be held
at Douglas on Thursday the 21st day of December 1882 at 11 o'clock in the
forenoon. Whereof all proper parties and persons are to have due and lawful
notice.
