Ballaugh
1886
158
This is the last will and testament of Alice Callister of Close Keil in the
parish of Ballaugh widow of Patrick Callister deceased.
Whereas I and my late husband Patrick Callister made a joint will dated
the twentieth day of March One thousand eight hundred and sixty and proved
as the will of the said Patrick Callister at a Chapter Court held
at Ramsey on the twenty seventh day of May One thousand eight hundred and
seventy whereby we disposed or intended to dispose of the whole of our real
and personal estate including one undivided half of a small piece
of land with the buildings thereon called Close Keil in Ballaugh. And
Whereas I have recently been informed that a doubt may arise as to whether
such half of Close Keil was in fact disposed of by such Will. And that
Letitia Teare wife of Thomas Teare of Andreas and her said husband now
intend to lay claim to such property on the grounds that the same
was not disposed of by such will and the said Letitia Teare was heiress
at law of my late husband although such claim has never hitherto been made.
Now in order to set aside any such doubts I do hereby declare that our
interest in the said property was included or intended to be included in
such will but in case there should be any dispute hereafter as to the
affect of such joint will and it should be decided that our interest in
Close Keil was not in fact disposed of by such will but that there was
an intestacy as to it. I hereby give devise and bequeath my estate and
interest therein to my daughter Elizabeth Dorothy Kaighin wife of Humphrey
Kaighin her heirs and assigns all other my real and personal estate of which
I have power to dispose. I also give devise and bequeath to my said
daughter Elizabeth Dorothy Kaighin absolutely and I appoint here sole
executrix hereof. In witness whereof I have hereunto
subscribed my name this the Thirty First day of December One thousand eight
hundred and eighty five. Alice Callister
Signed published and declared by the said testator Alice Callister as an
for her last will and testament in our presence who in her presence and
in presence of each other at her request have hereunto subscribed our names
as witnesses.
