COMMON LAW DIVISION
To his Honour Deemster Gill
The Humble petition of Evan Kaye of the Raggatt in the Parish of Patrick.
Sheweth:
That petitioners mother Mary Kaye of the Raggatt in the Parish of Patrick departed this life on or
about the 18th day of July instant having first made and executed her Last Will and Testament in
writing (undated but which in fact was made and published on the 17th July 1886) whereof she
appointed petitioner executor. That Petitioner is desirous of obtaining probate of the said Will
wherefore petitioner prays a hearing hereof Your Honour may be pleased to grant probate of the
said Will to your petitioner and ? will pray ?

Ordered that this Petition do come on to be heard at a Court to be holden at Peel on Monday the
24th day of July 1886 whereof all proper parties and persons are to have due notice.

I Mary Kaye widow of Henry Kaye of the Raggett near Peel do make and publish my last Will &
Testament in manner following that is to say:
First:
I do hereby revoke and cancel every former Will by me heretofore made.
Second:
I leave and bequeath to my son Henry Kaye Three Hundred Pounds as a legacy.
Third:
I leave and bequeath to each of my three sons Charles Quane Kaye, William Thomas Kaye and
Robert Clucas Kaye sixty pounds each as a legacy.
Fourth:
I leave and bequeath to my son Evan Kaye two Hundred Pounds as a legacy.
Fifth:
I also leave and bequeath to my said son Evan Kaye the whole of my live farm stock and the
outdoor farming implements and utensils.
Sixth:
I leave and devise my Household furniture and goods inside of the Dwelling House to be equally
divided between my four sons Henry Kaye, William Thomas Kaye, Evan Kaye and Robert Clucas
Kaye.
Seventh:
I leave and bequeath to my said son Evan Kaye the whole of the remainder of my personal estate
and appoint him residuary legatee of this my Will.
Eighth:
I nominate constitute and appoint him the said Evan Kaye, sole executor of this my Will.
As witness my name hereto the (left blank) day of (left blank) one thousand eight hundred and
eighty six.

In consideration of my brothers withdrawing all opposition to probate of the Will of my mother
Mary Kaye made on 17th day of July Instant being granted this day and in case the said probate shall
be so granted I agree to distribute my said mothers estate in accordance with a former Will made by
her dated the 17th day of May last (1886) so far as the state will extend.

At a Court holden at Peel on the 26th day of July 1886. The Annexed paper writing dated in the
year 1886 (but without bearing the month or the date of the month in which the same purports to be
executed inserted therein) having been proved to be the Last Will and Testament of Mary Kaye late
of the Raggatt in the Parish of Patrick widow deceased who died on the 18th day of July 1886 Evan
Kaye of the Raggatt aforesaid a son of deceased the Executor therein named is sworn well and truly
to fulfill and execute the same and to Administer the personal estate of the said deceased according
to Law.

We the undersigned do hereby acknowledge to have received from Evan Kaye Executor of Mary
Kaye deceased the sums set ? to our respective signatures which we do hereby declare and advise
that we have gone through and examined the claims set forth in the accounts of the said Executor
marked A and that the said account is a true and correct account in all particulars and we do hereby
release and discharge the said Evan Kaye and the said Estate from all further claims demand
liability or responsibility as witness our names this 16th day of February 1887.

MINUTES FOR JUDGMENT
Probate Session at Peel the 26th day of July 1886 Will of Mary Kaye deceased dated 1886 who died
18th July 1886 Probate granted to Evan Kaye of the Raggatt.

COMMON LAW DIVISION [Testamentary Jurisdiction]
Will of Mrs. Mary Kaye
Know all men by these presents that we Evan Kaye William Thomas Kaye and Robert Clucas Kaye
all sons of the deceased are jointly and severally and any two of us jointly bound unto our
Sovereign Lady the Queen in the sum of seven hundred pounds, to the payment whereof, well and
truly to be mad to our said Lady the Queen, her heirs, and successors, we bind and oblige ourselves
jointly and severally, and any two of us jointly, our Executors and Administrators, firmly by these
presents. As witness our subscriptions the 26th day of July in the year of Our Lord one thousand
eight hundred and eighty six.
The condition of our obligation is such, that if the above name Evan Kaye who seeks to obtain a
grant of Probate of the Last Will and Testament of Mary Kaye late of the Raggatt in Patrick but
now deceased, who died on or about the 18th day of July 1886, do, when lawfully called on in that
behalf; make or cause to be made a true and perfect inventory of all and singular the personal estate
and effects of the said deceased which have or shall come to his hands, possession, or knowledge,
or into the hands of any other person for them and the same so made do exhibit, or cause to be
exhibited, into the proper Registry in that behalf whenever required by law so to do: And the same
personal estate, and effects of the said deceased, which shall at any time come into the hands or
possession of the said Evan Kaye or into the hands or possession of any other person or persons for
him or which without default might have come into the hands or possession of the said Evan Kaye
do well and truly administer according to law, that is to say, do pay the debts and liabilities of the
said deceased so far as the aid personal estate will extend and the law bind the said Evan Kaye then
this obligation to be void and of no effect, or else to remain in full force and virtue.
