Arbory 1896 76 The humble petition of Ann Maddrell of Ballamaddrell in the parish of Arbory Widow. Sheweth as follows; 1. John Maddrell late of Ballamaddrell in the parish of Arbory and husband of your petitioner departed this life on the 21 day of Dec 1895 having first duly made and published his last will and testament whereof he appointed your petitioner executrix. 2. It is necessary that the said will should be proved. 3. The only next of kin of the said deceased resident on this island are your petitioner and one son and two daughters namely Robert Henry Maddrell, Mary Ann Maddrell, and Elizabeth Maddrell. Wherefore your petitioner humbly prays hearing hereof and that your honor may be pleased to grant probate of the said will of the said John Maddrell deceased to your petitioner and that your petitioner may have such other relief as is meet and she will pray. This is the last will and testament of me John Maddrell of Ballamaddrell in the parish of Arbory Gentleman. First I direct that all my just debts and funeral and testamentary expenses be paid by my executrix hereinafter named with all convenient speed after my decease. Secondly I give and devise unto my son Robert Henry Maddrell his heirs and assigns (subject to the provisions and direction hereinafter declared) all the estate, farm, lands and premises called Ballamaddrell in the parish of Arbory and also all that cottage land and premises situate in the said parish and purchased by me from George Quirk Esquire deceased, and also all the tithe purchased by me from George Quirk deceased and all other my real estate in the said parish of Arbory provided nevertheless and it is hereby specially directed that the said Robert Henry Maddrell shall upon my decease come into possession of one half or moiety and no more of all and singular the said estate, farm, cottage, lands, tithe, premises, and real estate hereinbefore set forth and described and upon the decease of my wife Ann Maddrell but not before shall come into possession of the other half or moiety thereof for it is my will and I hereby direct that she my said wife Ann Maddrell and her assigns shall possess occupy and enjoy without impeachment of waste for and during her natural life the one half or moiety of the said estate farm lands and premises of Ballamaddrell and also one half or moiety of the said estate, farm, lands, and premises of Ballamaddrell and also one half or moiety of the said Cottage, land, and premises and of the said tithe and of all and singular the real estate aforesaid and that she my said wife shall receive and take to her own use the rents, profits and issues of such one half or moiety thereof for and during her natural life. And it is hereby also provided and this devise is made on the express condition that my said son Robert Henry Maddrell shall and will upon my decease well and truly pay unto my said wife Ann Maddrell the sum of three hundred pounds Sterling. And I do hereby specially subject charge and encumber the whole of the said estate, farm, lands, cottage, and premises hereinafter mentioned with the payment of the said sum of three hundred pounds. Thirdly I give and bequeath to my son Robert Henry Maddrell to be possessed by him at my death also one half only of my farm, live stock, and one half only of my farm implements. Fourthly I give and bequeath unto my daughter Mary Ann Maddrell the legacy or sum of eleven hundred pounds Sterling. Fifthly I give and bequeath unto my son John James Maddrell the sum of fifty pounds sterling as he received nine hundred pounds from me when he was in business as a draper in Castletown. Sixthly I give and bequeath to my daughter Margaret Jane Maddrell the legacy or sum of seven hundred pounds sterling and the two hundred pounds which I gave to her husband Thomas Henry Moore for a note. Seventhly I give and bequeath to my daughter Frances Isabella Maddrell the legacy or sum of eleven hundred pounds sterling. Eighthly I give and bequeath to my daughter Elizabeth Maddrell the legacy or sum of eleven hundred pounds sterling. Ninethly I give and bequeath unto my son Thomas Fisher Maddrell the legacy or sum of five hundred pounds sterling. Tenthly And it is my will and I hereby direct that one half or moiety only of each and every of the aforesaid pecuniary legacies be paid within a year and a day after my decease, but without interest, and that the other half or moiety of each and every of the said pecuniary legacies be paid without interest upon the death of my said wife Anne Maddrell, and not before for it is my will and I direct that my said wife Ann Maddrell shall have and do take and receive to her own sole use the interest and profits which may arise from one half or moiety of each and every of the said pecuniary legacies for and during her natural life. Eleventhly As to the rest, residue, and remainder of my personal estate and effects whatsoever and wheresoever unto hereinbefore specifically disposed of over which I shall have a disposing power at the time of my decrease I give and bequeath the same to my said wife Ann Maddrell and I do hereby nominate and appoint her my said wife executrix and residuary legatee of this my last will and testament. In witness whereof I have hereunto subscribed my name this thirtieth day of December in the year one thousand eight hundred and eighty five.
