In the Goods of Eleanor Kaye, deceased.

To His Honour Charles Cheslyn Callow, Esquire, one of his Majesty's Deemsters for the said Isle 
and a Judge of the said Court and Division.

The humble petition of William Thomas Kaye of Fleetwood, George Edwin Kaye of 12 Elm Street, 
Fleetwood, Mariner, and Thomas Alfred Kaye of 9 Margaret Street, Sydney, Australia, but at 
present temporarily residing at 14 Market Street, Peel, Isle of Man, Mariner.

Sheweth:
That Eleanor Kaye late of Patrick Street in the town of Peel in the Isle of  Man, Widow, but now 
deceased (mother of your petitioners) departed this life on or about the 13th day of August 1911 
having first duly made and published her Last Will and Testament date the 15th day of October 1904 
whereof she appointed her sone the said Thomas Alfred Kaye sole Executor.

That your petitioners are desirous that Probate of the said Will of the said Eleanor Kaye may be 
granted to the said Thomas Alfred Kaye.

Whereof your petitioners humbly pray a hearing hereof and that your Honour may be pleased to 
grant Probate of the said Will of the said Eleanor Kaye deceased, to the said Thomas Alfred Kaye 
son of the said deceased the Executor named in the said Will and such other and further relief as is 
meet in the premise – And petitioners will pray.

Will of Eleanor Kaye late of Patrick Street in the town of Peel, Widow.

Know all men by these presents that we Thomas Alfred Kaye of 9 Margaret Street, Sydney, 
Australia but at present temporarily residing at 14 Market Street, Peel, Isle of Man, Mariner, 
Thomas Cowley Kermode of the Parish of   ?  Policeman and Henry Quayle of Church Street, Peel, 
Coal Merchant are jointly and severally and any two of us jointly bound unto our Sovereign Lord 
the King in the sum of Five Hundred Pounds to the payment whereof well and truly to be made to 
our said Lord the King, his heirs and successors, we bind and oblige ourselves jointly and severally 
and any tow of us jointly, our Executors and Administrators, firmly by the presents.

As witnesses our subscriptions the twenty third day of October in the year of Our Lord one 
thousand nine hundred and eleven.

The condition of our obligation is such, that if the above named Thomas Alfred Kaye (hereinafter 
called "the Executor") who seek to obtain a grant of Probate of the Last Will and Testament of 
Eleanor Kaye late of Patrick Street in the said town of Peel, Widow but now deceased, who died at 
Patrick Street, Peel, on or about the 13th day of August 1911 do, when lawfully called on in that 
behalf, make or cause to be made a true and perfect inventory of all and singular the personal estate 
and effects of the said deceased which have or shall come into his hands, possession, or knowledge, 
or into the hands of any other person for him and the same so made do exhibit, or cause to be 
exhibited, into the proper Registry in that behalf whenever required by law so to do:  and the same 
personal estate and effects of the said deceased which shall at any time come into the hands or 
possession of the Executor, or into the hands of any other person or persons for him or which 
without default might have come into the hands or possession of the Executor, do well and truly 
administer according to law, that is to say, do pay the debts and liabilities of the said deceased so far 
as the said personal estate will extend and the law bind the Executor, then this obligation to be void 
and of no effect, or else to remain in full force and virtue.

At Peel the 23rd day of October 1911.  The executing parties to the foregoing Bond Acknowledge 
the same to be their Act and Deed.

This is the Last Will and Testament of Eleanor Kaye of Patrick Street in the town of Peel, Widow.

I leave and bequeath to my son William Thomas Kaye the sum of two hundred pounds as a legacy.  
Also one feather bed, bolster and two pillows.

I leave and bequeath to my son George Edwin Kaye the sum of fifty pounds as a legacy.

I hereby nominate and appoint my son Thomas Alfred Kaye whole and sole executor and residuary 
legatee of my Real and Personal Estate.

In witness whereof I the said Eleanor Kaye have hereunto subscribed my name this the fifteenth day 
of October one thousand, nine hundred and four.

Signed by the said Eleanor Kaye as her last Will and Testament in the presence of us all present
at the same time and at their request have hereunto signed our names as Witnesses.

Common Law Division Testamentary Jurisdiction
At a Court holden at Peel on the 13th October 1911.  The annexed paper writing dated the 15th day 
of October 1904 having been proved to be the Last Will and Testament of Eleanor Kaye late of 
Patrick Street in the town of Peel, Widow deceases who died on the 13th day of August 1911 at 
Patrick Street.  Aforesaid Thomas Alfred Kaye of 9 Margaret Street in the city of Sydney Australia, 
Mariner, but at present temporarily residing at 14 Market Street in the town of Peel a son of the 
Testator the Executor  therein named is sworn well and truly to fulfil and execute the same and to 
administer the personal estate of the said deceased according to law.

Thomas Alfred Kaye of 9 Margaret Street in the city of Sydney Australia, but at present temporarily 
residing at 14 Market Street, Peel, Isle of Man, Mariner, Executor of the Last Will and Testament 
dated the 15th day of October 1904 of his mother Eleanor Kaye late of Patrick Street, in the said 
town of Peel, Widow, but now deceased who died on the 13th day of August 1911, and which said 
Will was proved at a Court holden at Peel on the 23rd day of October 1911 and Probate thereof 
granted to the said Thomas Alfred Kaye.

In Account with the Estate of the Said Eleanor Kaye, deceased.  ( an account available of 
expenditure)

I, the said Thomas Alfred Kaye, Executor of the said Will of the said Eleanor Kaye, deceased, do 
hereby certify that I have legally wound up the Estate of the said Eleanor Kaye by paying her debts, 
funeral and Testamentary expensed and the legacies contained in her said Will, and that the above is 
a true and correct Statement of Accounts of my Administration of the said Estate this 21st day of 
January one thousand nine hundred and twelve.

Street in the City of Sydney, Australia, Mariner, but at present temporarily residing at 14, Market 
Street in the town of Peel in the Isle of Man Executor of the Last Will and Testament dated the 
fifteenth day of October, one thousand, nine hundred and four, of his mother Eleanor Kaye late of 
Patrick Street in the said town of Peel, Widow, but now deceased, who died on the 13th day of 
August 1911, the sum of fifty pounds, being the amount of a legacy bequeathed to the said George 
Edwin Kaye by the said Will of his mother the said Eleanor Kaye, and which said Will was proved 
a Court holden at Peel on the 23rd day of October 1911, and Probate thereof granted to the said 
Thomas Alfred Kaye.

Wherefore the said George Edwin Kaye doth hereby release and discharge the said Thomas Alfred 
Kaye as such executor of the Will of the said Eleanor Kaye, and the heirs – executors and 
administrators of the said Thomas Alfred Kaye, and the estate of the said Eleanor Kaye from all 
further claims and demands for and in respect of the said legacy.

In Witness whereof the said George Edwin Kaye hath hereunto subscribed his name this nineteenth 
day of December, One thousand, nine hundred and eleven.

Margaret Street in the City of Sydney Australia, Mariner but at present temporarily residing at 14 
Market Street in the town of Peel in the Isle of Man, Executor of the Last Will and Testament dated 
the fifteenth day of October one thousand nine hundred and four of his mother Eleanor Kaye late of 
Patrick Street in the said town of Peel, Widow, but now deceased, who died on the 13th day of 
August 1911 the sum of two hundred pounds also one feather Bed Bolster and two pillows being 
the legacies bequeathed to the said William Thomas Kaye by the said Will of his mother the said 
Eleanor Kaye, and which said Will was proved at a Court holden at Peel on the 23rd day of October 
1911 and Probate thereof granted to the said Thomas Alfred Kaye.

Wherefore the said William Thomas Kaye doth hereby release and discharge the said Thomas 
Alfred Kaye as such executor of the Will of the said Eleanor Kaye, and the heirs executors and 
administrators of the said Thomas Alfred Kaye and the estate of the said Eleanor Kaye from all 
further claims and demands for and in respect of the said legacies.
