COMMON LAW DIVISION - - (TESTAMENTARY JURISDICTION).
BE IT KNOWN that Henry Collister Kaye of 34 Demesne Road in the borough of Douglas railway clerk (British Railways)
died......on the 15th day of april 1961 at Nobles Isle of Man Hospital and Dispensary Douglas aforesaid intestate
AND BE IT FURTHER KNOWN that at the date hereunder written Letters of Administration of all the Estate which by law devolves to and vests in the personal representative of the siad intestate were granted by Her Majesty's High Court of Justice of the Isle of Man at Douglas to James Herbert CAin of 24 Athol Street Douglas aforesiad advocates' managing clerk.

THIS DEED made this 22nd day of February one thousand nine hundred and sixty-two BETWEEN BERTHA KAYE of 34 Demesne Road in the Borough of Douglas Spinster (hereinafter called "the Releasor") of the one part and JAMES HERBERT CAIN of 24 Athol Street Douglas aforesaid Advocates' Managing Clerk Administrator of the person estate of HENRY COLLISTER KAYE late of 34 Demesne Road Douglas aforesaid Railway Clerk (British Railways) deceased of the other part.
WHEREAS the said Henry Collister kaye (hereinafter called "the Intestate") died on the 15th day of April 1961 a Bachelor and intestate and Administration to his personal estate and effects was at Douglas on the 9th day May 1961 granted to the said James Herbert Cain who as such Administrator as aforesaid is hereinafter called "the Administrator").
AND WHEREAS the Releasor is the sole next-of-kin of the Intestate and as such is entitled to the entire residue of the personal estate of the Intestate.
AND WHEREAS the Administrator hath prepared his Accounts showing the personal estate of the Intestate and his dealings therein (such Accounts being contained in the Schedule at the foot hereof and being hereinafter called "the said Accounts").
AND WHEREAS the Administrator hath paid and transferred to the Releasor the cash and securities specified in the said Accounts.
NOW THIS DEED WITNESSETH as follows :-
1. THAT the Releasor DOTH hereby own and acknowledge that she has examined the said Accounts and that she finds the same correct.
2. THAT the Releasor DOTH hereby own and acknowledge that the Administrator hath transferred to her the securities specified in item 14 (a) and (b) of the said Accounts having an approximate market value at the date of the Intestate's death of 4,701. 2. 8. and that the Administrator hath paid to her in cash the sum of 4,057. 1.4. together making a total of EIGHT THOUSAND SEVEN HUNDRED AND FIFTY-EIGHT POUND FOUR SHILLINGS (8,758. 4. 0.) which the Releaso DOTH hereby admit and declare represents the whole of the residue of the personal estate of the Intestate to which she is entitled as the sole next-of-kin of the Intestate.
3. THAT in consideration of the aforesaid transfer and payment the Releasor DOTH hereby RELEASE and DISCHARGE and IDEMNIFY the Administrator and his executors and administrators and the estate of the Intestate from and against all further actions accounts claims demands costs and liability whatsoever for or on account or in respect of the personal estate of the Intestate or the administration realisation or conversion thereof or of any part thereof or anything done omitted or neglected by the Administraot in or about the said estate or any part thereof or any other matter or thing in anywise relating to the premises.
IN WITNESS whereof the Releasor hath hereunto subscribed her name this the day month and year first before written.
