Developements
A City web site has been located which lists all development permits and appeals happening around town. This site will be monitored by the housing committee to aid in their vigilance in detecting out-of-scale housing. To access the site youself just follow the "simple"  proceedure below: 

Go to www.edmonton.ca 
Click on "Permits and Licenses" 
On the left hand blue side bar click on "Residential Information"  
On the right hand green bar click on "2004 Monthly Permit Summary" 
On the right hand blue bar, click on "Daily List of Developement Applications" 
Scroll down to "View On-Line" 
Click on "Application for Developemtn Permit" 
Enter the time period you want to check and chose McKernan from the drop down box. 
Click on "List Applications" .... the applications will be listed in chronological order... 
Voila... You are there!

Neighbourhood 
Regulations

(1) Front Yards 
a) The minimum Front Yard shall be consistent with the Setback of development on adjacent Sites and with the general context of the block face, but shall not be less than 3.0 m, and the principal building shall be located at or within 1.0 m of the Front Yard. 

b) A single Storey Unenclosed Front Porch or veranda may project a maximum of 2.0 m into a required Front Yard, provided that a minimum of 3.0 m is maintained between the front property line and the projected space, and the height of the front porch or veranda does not exceed one Storey. 
 

(2) Side Yards 
a) Where the Site Width is 12.0 m or less: 
the minimum for each interior Side Yard shall be 1.2 m regardless of building Height; 
the minimum Side Yard abutting a flanking public roadway other than a Lane shall be 1.5 m; 
on a corner Site where the building fronts on a flanking public roadway other than a Lane, the minimum Side Yard abutting the flanking public roadway shall be 3.0 m and; 

b) Where the Site Width is greater than 12.0 m and less than 18.3 m, the Side Yard requirements of the underlying Residential Zone shall apply. 

c) Where the Site Width is 18.3 m or greater: 
Side Yards shall total 20% of the Site Width, but shall not be required to exceed 6.0 m in total; 
the minimum interior Side Yard shall be 2.0 m; and 
on a corner Site the Side Yard requirements on the flanking public roadway other than a Lane, shall be in accordance with the requirements of the underlying Zone. 

A single Storey unenclosed porch or veranda may project a maximum of 2.0 m into a required Side Yard abutting a flanking public roadway other than a Lane, providing there is at least 1.5 m between the property line and the projected space, and the height of the porch or veranda does not exceed one Storey. 
 

(3) Rear Yard
The minimum Rear Yard shall be 40% of Site depth. Row Housing not oriented to a public roadway is exempt from this Overlay requirement. 
 

(4) Access 
There shall be no vehicular access from the front or flanking public roadway where an abutting Lane exists, and 
a) Treed Landscaped Boulevard is present along the roadway adjacent to the property line; or
b) the Site Width is less than 15.5 m. 

(5) Garages
The minimum Setback for a rear detached Garage shall be 1.2 m from the rear property line.

A rear detached Garages shall be full contained within the rear 12.8 m of the Site.  A principal building shall be separated from a rear-detached Garage by a minimum of 3.0 m.

If vehicular access is provided from the fronting public roadway, a Garage may protrude a maximum of 1.0 m beyond the front wall of the principal building and have a maximum width of 7.3 m or 35% of the site width, whichever is less. In no case shall the Garage be located less than 3.0 m from the front property line. 
 

(6) Design 
Each Dwelling that is adjacent to a public roadway other than a Lane shall have an entrance door or entrance feature such as a front porch, deck or landing area, at the front of the structure and oriented to the roadway. 

On Corner Lots the facades of a structure which face the front and flanking public roadways shall have consistent design elements, in terms of building materials and architectural features. 
 

(7) Height 
Where a structure is two or more Storeys in Height, and an interior Side Yard is less than 2.0 m, the applicant may be required to provide information regarding the location of windows and Amenity Areas on adjacent properties, and the windows of the proposed development shall be located to minimize overlook into adjacent properties. 

When a structure is more than 7.5 m in Height: 
a) dormers shall be recessed from the exterior walls of the structure; 
b) there shall be no dormer or gable roof on the side of the structure where a Side Yard is less than 2.0 m; and 
c)     not with standing clauses (a) and (b) above, an exception shall be made to allow a dormer which accommodates a stairwell to the upper 1/2 Storey, provided that the dormer does not exceed the width of the stairway, and it provides only the minimum required headroom for a staircase as outlined in the Alberta Building Code. 

The Basement elevation of structures of two or more Storeys in Height shall be no more than 1.2 m above grade. The Basement elevation shall be measured as the distance between Grade level and the floor of the first Storey. 


 

Mature Neighbourhood Overlay

This overlay was created to ensure that development in mature neighbourhoods follows the traditional character and design of the surrounding area. 

Regulations for mature neighbourhoods can be found in Section 814 of the Edmonton Zoning Bylaw. 

This document is meant as a guide only, to assist you in planning for development of a property. 
 

Exceptions (in the case of variance)

Where an application for a Development Permit does not comply with the regulations contained in this brochure, the applicant is required to consult with the neighbourhood as follows: 
a) contact your neighbours or assessed land owners within a distance of 60.0 m of the subject site at least 21 days before you apply; 
b) contact your neighbourhood Community League President at least 21 days before you apply; 
c) you must outline the exceptions to the regulations to all contacted parties; 
d) you must document all opinions, concerns and recommendations regarding the proposed development; and 
e) you must submit this documentation as part of your development permit application. 

Please check with our office for clarification or to assist you in completing your application. It is recommended that you create a consultation letter with a place for the date, name with an address of the person that has been consulted, and a signature.

Application Proceedure

When applying for a Development Permit and a Building Permit, you must provide: 
the municipal address and/or 
the legal description (lot, block, plan number) of the property 
three (3) copies of the site plan 
context plan showing setbacks on the adjacent properties 
three (3) sets of construction plans drawn to a minimum scale of 1:100 showing all dimensions: 

1. foundation plan 
2. floor plans 
3. elevation drawings, (showing the view from north, south, east and west) 
4. cross-section plan and construction specifications 
5. required application fees 
6. photographs are required where construction has occurred without a permit, application fees will be doubled. 
Processing Your Application

Your development plans are examined by a Safety Codes Officer to prepare a Building Permit. 

If your development application is refused, you have the right to appeal the Development Officer’s decision to:
