The Mediator is a neutral person
that helps parties involved in a dispute to negotiate and agree
upon their own terms of settlement.
The Mediator encourages communication, identifies common areas,
focuses and defines areas of disagreement and assists the parties to reach resolution of outstanding issues.
A Mediator does not impose solutions or take sides. A Mediator
assists parties to reach an agreement acceptable to the parties outside of
courtrooms and litigation.
A Mediator does not replace legal counsel for the parties. Each
party will be encouraged to consult their lawyer for advice throughout the
mediation process and for independent legal advice respecting any mediated
terms of settlement.
A good Mediator will work with legal counsel to ensure the best
possible agreement is reached.
